We process personal data that we receive from our business partners in the context of our business relationships.
We also process personal data that we lawfully obtain from public sources (e.g., commercial registers, press, internet) or that are legitimately transmitted to us by other ALTANA companies or other third parties (e.g., social media, credit agencies).
In the case of applications for employment, we process personal data that we receive directly from applicants.
Specifically, we process the following data:
- Master data on the business relationship with our business partners (name of the contact person, business address and business contact details)
- Correspondence (e.g. correspondence)
- Advertising and sales data
- Applicant data
We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR). In the case of companies based in Switzerland, we process personal data in accordance with the provisions of the Swiss Data Protection Act (DPA).
1.1 Based on your consent (Art. 6 para. 1 a GDPR)
If you have given us consent to process personal data for specific purposes (e.g., newsletters), the lawfulness of this processing is based on your consent. Consent given can be revoked at any time. Revocation of consent does not affect the lawfulness of the data processed until the revocation.
1.2 Based on legal requirements (Art. 6 para. 1 c GDPR)
We are subject to various legal obligations (e.g., tax and customs laws). This includes the disclosure of personal data to competent authorities and bodies (e.g., tax office, professional association, financial institutions, and trustees).
The purposes of the processing include, among others, identity and age verification, screening based on anti-terror lists, fulfillment of tax control and reporting obligations, and the assessment and management of risks.
1.3 In the context of balancing interests (Art. 6 para. 1 f GDPR)
We process the data of employees of our business partners based on our legitimate interest.
Examples:
- Processing of business transactions with our business partners, e.g., order or contract processing
- Maintenance and development of the business relationship within our CRM systems
- Market and opinion research, provided you have not objected to the use of your data
- Assertion of legal claims and defense in legal disputes
- Ensuring IT security and IT operations of the company
- Prevention and investigation of criminal offenses
- Measures for building and plant security
- Sharing within the group, considering Recital 48 of the EU GDPR
1.4 In the context of applicant management and our recruiting process (Art. 88 GDPR in conjunction with § 26 BDSG or Art. 6 para. 1 sentence b GDPR)
We process applicant data to establish an employment relationship
- based on Art. 6 para. 1 sentence b GDPR or
- where a national regulation exists, based on Art. 88 GDPR in conjunction with the respective national regulation. For Germany, the provisions of § 26 BDSG (Federal Data Protection Act) therefore apply.
Your personal data is disclosed only if a legal basis permits this. Within the company, those departments that need your personal data to fulfill our contractual and legal obligations receive access to it. Additionally, the following entities may receive your data:
- Processors we use (Art. 28 GDPR), particularly in the areas of IT services, sales, logistics, and printing services, which process your data on our instructions
- Public authorities and institutions (e.g., tax office, customs authorities, professional associations) where there is a legal or regulatory obligation
- Other entities for which you have given us your consent (e.g., in the context of research projects)
- Affiliated companies within the group, considering Recital 48 of the GDPR
A transfer of data to entities in countries outside the European Economic Area (so-called third countries) takes place, provided
- this is required by law (e.g., tax reporting obligations),
- you have given us your consent, or
- t is permitted within the context of balancing interests and considering Recital 48 of the EU GDPR within affiliated companies, provided an adequate level of data protection exists in the third country (Art. 45 GDPR) or we have agreed upon suitable guarantees with the affiliated companies and enforceable rights and effective legal remedies are available (Art. 46 GDPR).
- it is necessary for the execution of orders (e.g., cooperation with our production sites in third countries)
Additionally, no personal data is transferred to entities in third countries or international organizations. However, we use service providers for certain tasks who may have their headquarters, parent company, or data centers in a third country. A transfer is permissible if the European Commission has decided that an adequate level of protection exists in a third country (Art. 45 GDPR). If the Commission has not made such a decision, we may only transfer personal data to a service provider in a third country if appropriate guarantees are contractually agreed upon, and enforceable rights and effective legal remedies are available (Art. 46 GDPR).
We process and store your personal data as long as it is necessary for the purposes mentioned in Section 4 or required for the fulfillment of contractual and legal obligations, as well as for the pursuit of legitimate interests (e.g., preserving evidence or documentation) within the framework of legal limitation periods. We regularly delete personal data if the aforementioned requirements no longer apply.
You have the right to
- Information (Article 15 GDPR)

- Restriction of processing (Article 18 GDPR)
- Data portability (Article 20 GDPR)
- Object (Article 21 GDPR)
In the case of the right to information and the right to deletion, there may be restrictions in Germany according to §§ 34 and 35 BDSG and in Switzerland according to Art. 26 DPA. Additionally, there is a right to lodge a complaint with a competent data protection supervisory authority (Art. 77 GDPR).
As part of the business relationship with our business partners, you, as an employee of the business partner, must provide the personal data necessary for the initiation and implementation of the business relationship and the fulfillment of the associated contractual obligations between our business partner and us or for which we are legally obliged to collect.
If you have chosen to apply for a job with us, you must provide all the data necessary to establish an employment relationship.
We do not use fully automated decision-making (so-called scoring) according to Art. 22 GDPR.
Profiling according to Art. 4 No. 4 GDPR is any form of automated processing of personal data to evaluate, analyze, or predict certain aspects relating to a natural person (e.g., work performance, economic situation, personal preferences or interests, reliability, behavior, location).
We do not use profiling.
12.1 Right to object to processing based on balancing of interests
You have the right to object at any time, for reasons arising from your particular situation to the processing of personal data concerning you, which is based on Article 6(1)(f) of the GDPR (data processing based on a balance of interests); this also applies to profiling based on these provisions within the meaning of Article 4(4) of the GDPR. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate reasons for the processing that outweigh your interests, rights, and freedoms or the processing serves to assert, exercise, or defend legal claims.
12.2 Right to object to data processing for direct marketing purposes
We may process your data for direct marketing purposes within the framework of the legal provisions. You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling if it is related to such direct marketing. If you object to processing for the purposes of direct marketing, we will no longer process your personal data for these purposes.
