1.1 Scope of the processing of personal data

As a matter of principle, we only process your personal data if you contact us via this website, if this is necessary to provide a functional website or if it is necessary for the presentation and use of our contents, offers and services. Without the processing we cannot provide our offer, a use would not be possible.


1.1.1 Provision of the website

When you visit our website, we log the IP address (i.e. the Internet address) of the requesting computer and other general usage data such as date and time ("user-related data") in order to assess which parts of our website are of particular interest. Your usage data is not linked to your full IP address. The processing of this data serves the internal evaluation of the frequency of use of our website, we hereby exercise our legitimate interest in checking the efficiency of our services. The legal basis for the processing of the data is Art. 6 para. 1 lit. f EU Data Protection Basic Regulation ("DSGVO").

There is a contact form on our website which can be used for electronic contact. If you take this opportunity, the data entered in the input mask will be transmitted to us and processed by us. The processing of the personal data from the input mask serves us solely to process the contact and your request. The legal basis for the processing of data is Art. 6 para. 1 lit. f DSGVO. The processing of the contact also represents our legitimate interest in data processing. Further legal basis for the processing of the data is, with your consent, Art. 6 para. 1 lit. a DSGVO. You can informally revoke any consent you have given us at any time. If the purpose of the contact is the conclusion of a contract, the additional legal basis for the processing is Art. 6 para. 1 lit. b DSGVO.

 

1.1.3 E-mail newsletters and postal advertising

If you register for our newsletter, we will use the data required for this purpose or data provided separately by you to send you our e-mail newsletter regularly on the base of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO.

You can unsubscribe from the newsletter at any time, either by sending a message to the contact option described below or by using a link provided for this purpose in the newsletter. After unsubscribing, we will delete your e-mail address unless you have expressly consented to further use of your data or we reserve the right to use data beyond this which is permitted by law and about which we inform you in this declaration.

The newsletter is sent by a service provider on our behalf, to whom we pass on your e-mail address for this purpose. This service provider is located within a country of the European Union or the European Economic Area.

Furthermore, we reserve the right to use your first and last name as well as your postal address for our own advertising purposes, e.g. to send you interesting offers and information on our products by post. 1.2 Legal basis for the processing of personal data

Insofar as we obtain your consent for the processing of personal data, Art. 6 para. 1 lit. a DSGVO serves as the legal basis.

When processing personal data which is necessary for the performance of a contract to which you are a party, Art. 6 para. 1 letter b DSGVO serves as the legal basis. This also applies to processing operations which are necessary to carry out pre-contractual measures.

Insofar as the processing of personal data is necessary to fulfil a legal obligation to which we are subject, Art. 6 para. 1 lit. c DSGVO serves as the legal basis.

In the event your vital interests or those of another natural person make it necessary to process personal data, Art. 6 para. 1 lit. d DSGVO serves as the legal basis.

If the processing is necessary to protect a legitimate interest of ours or of a third party and if your interests, fundamental rights and freedoms do not outweigh the former, Art. 6 para. 1 lit. f DSGVO serves as the legal basis for the processing.

 

1.3 Transfer of data to third parties

All personal data processed in connection with the provision of this website may be passed on by us to our group companies and providers of technical services and services as well as financial service providers who are used by us as processors in accordance with the provisions of the DSGVO. Sometimes the financial service providers themselves collect this data when you open an account there. In this case you must log in to the financial services provider with your registration data during the registration and order process. After complete processing of the contract or deletion of the customer account, your data will be restricted for further processing and deleted after expiry of the statutory storage periods, unless you have consented to further use of your data or we have reserved the right to process your data in a more extensive and permissible manner, about which we inform you in this declaration.

2. Use of cookies

Our website uses cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on the user's computer system. 2.2.1 Google Analytics

Our website uses Google Analytics to design and improve the website in line with requirements. Google Analytics uses so-called cookies, which are stored on your end device and enable an analysis of your use of the website. The information generated by the cookie is usually transferred to a Google server in the USA and stored there. We use the extension of IP anonymization on this website, i.e. your IP address is shortened by Google beforehand.

2.2.4 Google Tag Manager

You can agree or decline the use of the Google Tag Manager via the Consent Manager. Through this service, website tags can be managed through an interface. The Google Tool Manager only implements tags. This means: no cookies are used, and no personal data is collected. The Google Tool Manager triggers other tags, which in turn may collect data. 2.4 LinkedIn Retargeting and Tracking

We use conversion tracking technology on our Website and the retargeting feature of LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland ("LinkedIn"). For this purpose, our website incorporates the LinkedIn Insight tag, which enables LinkedIn to collect statistical, pseudonymous information about your visit and use of our website and to provide us with relevant aggregated statistics on this basis. 2.5. easyFeedback

On this website we use easyFeedback to collect and store anonymous surveys. Participation is voluntary.

Multiple participation is prevented by a cookie block. With cookie blocking, easyFeedback sets a cookie on the device you use for the survey and matches it with your data. If a cookie with the survey ID is detected on your device, multiple participation can be prevented. The cookie is automatically deleted after 90 days.

When you participate in a survey, easyFeedback stores your answers and the type of device you use to participate in the survey and provides this to us in the form of graphs and as Excel and CSV files. easyFeedback does not in any way create user profiles of participants or store demographic or geographic data. Your answers remain stored on the server until they are deleted by us.

3. Career portal / applicant data

You have the opportunity to apply for advertised positions via our website or send us an unsolicited application. During the online application process, you provide us with personal data which we process for the purpose of the application procedure. All personal data that you provide during the application process is only collected by us for the purpose of carrying out the application process.
 

3.1 What information do we collect?

During the application process, we record all the information you provide us with during your application, as well as any other data we learn during a job interview or online assessments, in particular evaluations.

It goes without saying that this evaluation does not contain any defamatory or derogatory statements, only information that is specifically related to the evaluation and the employment procedure or your job profile will be included.
 

3.2 Handling of your application data

3.3 Transfer of data to third countries

3.4 Storage of your data, applicant pool

Your data will be deleted after completion of the application procedure in accordance with the applicable data protection regulations, particularly with regards to retention periods. As part of the application process, you have got the opportunity to consent to the storage of your data in our applicant pool. If you do so, your application data and documents will continue to be stored in our system and will be checked for suitability when vacancies arise. If you do not consent or revoke your consent, we will delete your personal data in accordance with legal requirements, unless we are legally obliged to retain your data. You can revoke your consent informally at any time.
 

3.5 Purpose of data processing, legal basis, storage period

We collect and process your personal data within the framework of an application procedure for the purpose of initiating a possible employment relationship.

The legal basis for the processing of the data is Art. 6 para. 1 letter b DSGVO, as well as Art. 6 para. 1 letter a, insofar as you have given us your consent for a specific processing of your data.

Your applicant data will generally be deleted or blocked as soon as the purpose of storage, i.e. the execution of an application or employment relationship, ceases to apply. However, your data will not be deleted if the European or national legislator stipulates an archiving obligation for a certain period of time after the end of the application procedure, or if you have voluntarily consented to a longer storage of your data. In these cases, the data will be deleted after the end of the archiving period or after expiry or revocation of your consent. Revocation of your consent is possible at any time.
 

4. Data processing in the ECKART GmbH web shop

If you want to order something in the ECKART web shop, you must first register with your data and create a customer account. Your data will be entered into an input mask, transmitted, saved and saved for future purchases.

4.1 Description and scope of data processing
The following personal data is collected as mandatory information during the registration process:

- Last name

- Company address (street, house number, postcode, city, country)

Registration in our web shop is not possible without providing this data. We will also store your IP address and the date and time of access. If you have decided to voluntarily provide a title or telephone number, these will also be stored.

By submitting the digital application form you initiate the creation of a personalized, password-protected customer account. After registration, a confirmation e-mail is sent, which completes the creation of the customer account. A further confirmation is not necessary.
 

4.2 Data collection after registration

After successful registration your personal customer number will be assigned, and the medium of your registration will also be saved. In addition, your purchases (date, item, item number, quantity, price, currency, type of transaction) are registered and saved. In addition, we collect and store your other voluntary information, which you provide in your customer account.

The data collected is necessary for customer service and to improve the user experience. For example, your name serves as identification. The email address or postal address you provide will be used for sending the invoice or goods.

Via the customer account you can view the data of your completed, open or recently shipped orders as well as correct/manage the data you provided during registration.
 

4.5 Duration of data processing

The data will be deleted after expiry of the statutory retention periods, unless you have consented to further use of your data or we have reserved the right to carry out further and permissible data processing, about which we inform you in this declaration.
 

4.6 Right of revocation; right to removal

To delete your registration or to change the data stored about you, you can contact us by e-mail or send a message (e.g. by fax or letter) to the ECKART contact details given in section 1.
 

5.1 CRM System from Salesforce

The personal data collected by you in connection with the registration in the customer account for the web shop as well as the personal data collected when registering for the newsletter (see 1.1.3 above) are transferred to the CRM system ("Customer Relationship Management") of the cloud provider Salesforce (salesforce.com Germany GmbH, Erika-Mann-Str. 31, 80636 Munich, Germany; "Salesforce") and managed there. An order processing contract has been concluded between us and Salesforce in accordance with Art. 28 DSGVO. The data collected by Salesforce is protected by Secure Socket Layer (SSL) technology, which uses both server authentication and data encryption. Salesforce.com has also implemented an advanced security method based on dynamic data and coded session IDs and maintains the Site in a secure server environment that uses a firewall and other advanced technologies to prevent interference or intrusion attempts. Salesforce.com has been awarded the Trust Privacy Seal. Salesforce itself restricts access to the information it collects to the legally permitted means of access.

The use of the services of Salesforce is in accordance with Art. 6 para. 1 sentence 1 letter f DSGVO due to our legitimate interest, to optimize our sales and marketing processes and to manage customer accounts and newsletter subscribers.
 

5.2 Legal basis for data processing

By logging in with your customer account, you have consented to the processing of your data, which is why the legal basis for this data processing is Art. 6 para. 1 sentence 1 letter a DSGVO. Furthermore, the processing of the data you have provided is necessary for the execution of the order, so that Art. 6 para. 1 sentence 1 lit. b DSGVO constitutes an additional legal basis for the processing of the data. Furthermore, we have a legitimate interest in the processing of the data in accordance with Art. 6 para. 1 lit. f DSGVO.

You have the possibility to revoke your consent to data processing or to object to data processing at any time. As already explained, you have the possibility to delete the registration of your customer account at any time and thus to object to the further use of your data.
